Personal and Professional Background 

Meisha is an experienced litigation lawyer, primarily in the insurance industry. 

 

In particular, Meisha has acted for and advised various domestic and overseas insurers and underwriters, state government bodies and local governments as well as insureds in relation to public liability, professional indemnity claims, professional disciplinary complaints and general commercial disputes.

 

Meisha’s practice has involved defending claims involving:

  • Advice on a financial broker’s entitlement to indemnity under a professional indemnity policy;
  • The successful defence of an insurer in relation to an allegation that it owed a tortious duty of good faith to a third party not named in an insurance policy: see CGU Workers Compensation (NSW) Limited (ACN 003 181 002) v Garcia [2007] NSWCA 193 (a decision which has been picked up for codification in the Insurance Contracts Act Amendment Bill currently before parliament);
  • The liability of accountants arising from alleged negligent advice on capital gains tax and superannuation;
  • Disciplinary complaints against private certifiers;
  • The civil liability of private certifiers, project managers, property valuers, architects and engineers;
  • The liability of physiotherapists, both in civil and disciplinary actions;
  • The liability of occupiers and cleaners of shopping centres and other commercial properties;
  • The liability of various local governments in relation to personal injuries sustained on its roads, footpaths and other property, for example see: Council of the City of Liverpool v Turano & Anor [2008] NSWCA 270;
  • The liability of an energy supplier in relation to personal injuries and property damage sustained on its property or as result of its assets or works;
  • The liability of a rail authority in relation to personal injuries and deaths on its railways and other property;
  • The liability of a major manufacturer of asbestos products;
  • The liability of a major manufacturer of building products;
  • The quantification of damages for loss of property damage, pure economic loss (including loss of crop) and personal injuries (including catastrophic injuries).

Meisha is also a member of Women in Insurance and the Risk Management Institute of Australasia.
